Frequently Asked Questions About Civil Litigation

Our attorneys can help answer any questions you have about civil litigation. Here are some commonly asked questions:

How long does civil litigation take?

The time it takes to settle civil litigation often depends on the complexity of a case. If a case can be settled outside of court, an agreement could be made within just a few months. However, if a case cannot be settled outside of court and goes to trial, the litigation process could take over a year. As your attorneys, our goal is to quickly settle your civil litigation case in your favor.

What are the potential outcomes of civil litigation?

There are several possible outcomes to a civil litigation claim. For starters, a settlement may be made between parties that will mutually benefit each side. This settlement may include the fulfillment of certain obligations, payment of damages or the transfer of property.

If a settlement cannot be reached easily, then a court may review the case. A judgment may be made in favor of one party, which could likewise lead to compensation, asset transfer or fulfillment of certain obligations.

Some cases may be dismissed. A dismissal can occur when there is not enough evidence to support a case. A dismissal can benefit a party if a claim is filed against them. Whether you are pursuing or defending a civil litigation case, our attorneys can represent you.

Can I settle a civil dispute without going to court?

Yes. A civil litigation case can be negotiated through mediation. Mediation allows both parties to discuss what they want out of a case and to find an amicable resolution.

What are the statute of limitations for civil litigation cases in Georgia?

The statutes of limitations for a civil litigation case can depend on the type of legal issue a party is pursuing. For example, a party may have six years to file a contract dispute claim but only four years to settle a real estate issue. Talk to an attorney to learn how long you have to prepare for your case.
